תקנון שימוש — רשימתי / Terms of Service

ברוכים הבאים ל"רשימתי" (להלן: "האפליקציה"). השימוש באפליקציה מהווה הסכמה לתקנון זה. בעל האפליקציה: שמעון, עוסק פטור, ישראל. פניות: reshimati.il@gmail.com.

1. השירות

האפליקציה מאפשרת יצירה, ניהול ושליחה של תזכורות אישיות, ניהול רשימות (קניות, מזוודה, todo, מותאם אישית), שיתוף רשימות בין משתמשים, יצירת רשימות בעזרת AI, סנכרון יומן Google, תזכורות מבוססות מיקום, גיבוי, וידג'טים, ומידע יהדות אופציונלי (תאריך עברי, חגים, זמני הלכה, ימי זיכרון). השירות מוצע במודל freemium: גרסה חינמית עם פרסומות, ומסלול מנוי בתשלום ללא פרסומות ועם תכונות מתקדמות.

2. חשבון משתמש

השימוש מחייב חשבון Google תקין.
המשתמש אחראי לשמירת אבטחת חשבונו.
אסור להעביר את החשבון לאחר.
גיל מינימום: 16.

3. מנוי בתשלום

מחיר: 29.90 ₪ לשנה.
תקופת ניסיון חינם: 7 ימים.
חידוש אוטומטי בתום התקופה אלא אם בוטל לפני המועד.
ביטול מנוי מתבצע דרך הגדרות Google Play בלבד.
החיוב מתבצע באמצעות Google Play Billing.

4. מדיניות החזר

החזרים מנוהלים בהתאם למדיניות Google Play (לרוב — בקשת החזר אפשרית בתוך 48 שעות מרגע הרכישה). בנוסף, ובהתאם לחוק הגנת הצרכן, התשמ"א-1981, על מוצרים דיגיטליים שלא נצרכו עומדת לצרכן זכות ביטול תוך 14 יום. ביטול מנוי שכבר נעשה בו שימוש משמעותי לא יזכה בהחזר מעבר למתחייב על פי דין.

5. שימוש מותר ואסור

אסור:

הנדסה לאחור (reverse engineering), פירוק קוד, שינוי או יצירת יצירה נגזרת.
שימוש לרעה: ניצול לרעה של API, בקשות בכמות חריגה, ניסיון פגיעה במשתמשים אחרים.
שליחת ספאם, תוכן בלתי חוקי, מטריד, מעודד אלימות או הפרת זכויות יוצרים.
גישה לחשבון של משתמש אחר ללא הרשאה.
בפיצ'ר יצירת רשימה ב-AI: הזנת תכנים פוגעניים, מסיתים, גזעניים, מיניים, מפרי-זכויות, או ניסיון להוציא מידע אישי של אחרים מהמודל.
ברשימה משותפת: הוספת תוכן בלתי חוקי / מטריד למשתמשים אחרים שמחזיקים את קוד השיתוף.

אנו רשאים להשעות או לסגור חשבון שמפר את התנאים, ללא הודעה מוקדמת במקרים חמורים.

5א. רשימות משותפות

בעלי רשימה משותפת אחראים לתוכן שנכנס לרשימה שלהם.
קוד שיתוף של 8 תווים מקנה גישת קריאה וכתיבה — כל מי שמחזיק בו יכול להוסיף, לסמן, ולמחוק פריטים.
מומלץ לשתף את הקוד רק עם בני משפחה / שותפים שאתה סומך עליהם.
אנו לא אחראים לתוכן שמשתף שלישי הוסיף לרשימה שלך — אך תוכל לעזוב את הרשימה בכל עת.

5ב. פיצ'ר AI (Anthropic Claude)

השימוש כפוף למדיניות השימוש של Anthropic. אסור להזין תכנים האסורים על-פי מדיניותם.
אין הבטחה שהתוצאות המוחזרות מ-AI יהיו מדויקות, מלאות, או מתאימות לכל מטרה. בדוק את הרשימה לפני השימוש.
אנו עשויים להגביל את כמות הבקשות היומית למניעת שימוש לרעה.

5ג. תזכורות מבוססות מיקום

הפיצ'ר משתמש בהרשאת מיקום ברקע (background location) באנדרואיד.
הפעלת הפיצ'ר עשויה להגביר צריכת סוללה.
אין הבטחה שהתזכורת תופעל בדיוק ברגע ההגעה למיקום — תלוי בדיוק GPS, בהגדרות החיסכון בסוללה של המכשיר, ובמצבי DND.

6. קניין רוחני

כל הזכויות באפליקציה, לרבות העיצוב, הקוד, הסמלים והתוכן, שמורות לבעל האפליקציה. תוכן שיצר המשתמש (תזכורות) נותר בבעלותו, אך הוא מעניק לנו רישיון מוגבל לאחסן ולעבד אותו לצורך אספקת השירות.

7. הגבלת אחריות

השירות ניתן "AS IS" — כפי שהוא, ללא התחייבות לזמינות, לדיוק או להתאמה למטרה כלשהי. בעל האפליקציה לא יישא באחריות לכל נזק עקיף, תוצאתי, מקרי או מיוחד הנובע משימוש בשירות, לרבות אובדן נתונים, אובדן רווחים או החמצת תזכורות. סך האחריות המצטברת לא יעלה על הסכום ששילם המשתמש בשנים-עשר החודשים שקדמו לאירוע.

הערה: אל תסתמכו על האפליקציה ככלי קריטי לבריאות או לבטיחות. אנו לא מתחייבים שכל תזכורת תישלח בזמן.

8. שינויים בשירות ובתקנון

אנו רשאים לעדכן את התקנון מעת לעת. במקרה של שינוי מהותי, נודיע על כך בתוך האפליקציה ובדוא"ל לפחות 30 יום מראש. המשך שימוש לאחר כניסת השינוי לתוקף יהווה הסכמה.

9. סיום שירות

המשתמש רשאי לסיים את השימוש בכל עת על ידי מחיקת החשבון. אנו רשאים להפסיק את הפעלת השירות בהודעה של 30 יום מראש.

10. דין וסמכות שיפוט

על תקנון זה יחולו דיני מדינת ישראל. סמכות השיפוט הבלעדית בכל מחלוקת הנובעת מהשימוש בשירות נתונה לבית המשפט המוסמך בתל אביב-יפו.

Welcome to "Reshimati" ("the App"). Use of the App constitutes acceptance of these Terms. App owner: Shimon, Osek Patur, Israel. Contact: reshimati.il@gmail.com.

1. The Service

The App lets you create, manage and deliver personal reminders, manage lists (shopping, packing, todo, custom), share lists between users, generate lists with AI, sync with Google Calendar, set location-based reminders, back up data, use home-screen widgets, and access optional Jewish content (Hebrew date, holidays, halachic times, yahrzeit reminders). The service is offered as freemium: a free tier with ads, and a paid subscription tier without ads and with additional features.

2. User Account

Use requires a valid Google account.
You are responsible for the security of your account.
You may not transfer your account to anyone else.
Minimum age: 16.

3. Paid Subscription

Price: 29.90 NIS per year.
Free trial: 7 days.
Auto-renews at the end of each period unless canceled in advance.
Cancellation is handled exclusively through your Google Play settings.
Billing is processed via Google Play Billing.

4. Refund Policy

Refunds are governed by Google Play policy (typically — refund requests can be submitted within 48 hours of purchase). Additionally, under the Israeli Consumer Protection Law (1981), digital goods that have not been substantially consumed are subject to a 14-day cooling-off period. A subscription that has already been used in a meaningful way will not be eligible for a refund beyond what is required by law.

5. Permitted and Prohibited Use

You may not:

Reverse engineer, decompile, modify or create derivative works.
Abuse the service: API misuse, excessive requests, attempts to harm other users.
Send spam, unlawful content, harassment, content inciting violence or copyright infringement.
Access another user's account without permission.
In the AI list generator: input offensive, inciting, racist, sexual, rights-infringing content, or attempt to extract personal data of others from the model.
In a shared list: add unlawful or harassing content for other users holding the share code.

We may suspend or terminate any account that breaches these Terms, without prior notice in serious cases.

5a. Shared Lists

Owners of a shared list are responsible for the content added to their list.
An 8-character share code grants read+write access — anyone holding it may add, check, or delete items.
Share the code only with family / partners you trust.
We are not responsible for content added by other parties to your list — but you can leave the list at any time.

5b. AI Feature (Anthropic Claude)

Use is subject to Anthropic's Usage Policy. You may not input content prohibited by their policies.
No guarantee that AI-returned results are accurate, complete, or fit for any purpose. Verify the list before using.
We may rate-limit daily requests to prevent abuse.

5c. Location-Based Reminders

This feature uses Android's background location permission.
Enabling it may increase battery consumption.
No guarantee that the reminder fires exactly upon arrival — depends on GPS accuracy, battery saver settings, and DND modes.

6. Intellectual Property

All rights in the App, including design, code, logos and content, are reserved by the App owner. User-generated content (reminders) remains owned by you, but you grant us a limited license to store and process it for the purpose of operating the service.

7. Limitation of Liability

The service is provided "AS IS", with no guarantee of availability, accuracy or fitness for any particular purpose. The App owner shall not be liable for any indirect, consequential, incidental or special damages arising from the use of the service, including data loss, lost profits or missed reminders. Total cumulative liability shall not exceed the amount paid by the user in the twelve months preceding the event.

Note: Do not rely on the App as a critical health or safety tool. We do not guarantee that every reminder will be delivered on time.

8. Changes to the Service and Terms

We may update these Terms from time to time. For material changes, we will notify you in-app and by email at least 30 days in advance. Continued use after a change takes effect constitutes acceptance.

9. Termination

You may stop using the service at any time by deleting your account. We may discontinue the service with 30 days' prior notice.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction over any dispute arising from the service is granted to the competent court in Tel Aviv-Yafo.
